I agree with Mr. Fortney and would add that the answer also depends on when the vacation is considered earned. If you haven't done so already send them a letter demanding payment and a precise explanation as to why they refuse to do so. You should also demand a copy of all their written policies regarding vacation pay. You should then share the policies with an employment lawyer to advise regarding your rights.

It means that any issue can be considered, even if not decided by the preceding determinations. You need to advise the UCRC of any such additional issues.

I highly recommend hiring a lawyer to represent you at the hearing. Do not try to do this by yourself. Most lawyers will handle the hearing on a contingent fee basis.
