You may have a claim for failure to accommodate a disability under the Americans with Disabilities Act (ADA). These cases are very fact specific and employers do have certain exceptions such as when they can show that the accommodation would create an “undue burden” on their operations. Not every complaint that an employee makes about mistreatment is protected legally from retaliation. There are certain laws that contain anti-retaliation protection when an employee engages complains to management or HR that s/he believes that law was violated. Examples include the federal laws prohibiting discrimination and harassment based on sex, age, race, national origin, religion, pregnancy and disability. For example, if you are retaliated against for reporting your supervisor for race discrimination, that would be illegal.
