I met with a counselor through my work's Employee Assistance Program (EAP) because of COVID anxiety and he felt a work from home accommodation was appropriate due to it effecting my ability to work, sleep, and concentrate. EAP does not allow him to complete the accommodation form but he wrote a summary which my physician used to request a work from home accommodation for me. My employer won't follow the request because "to be consistent with other staff who have requested this accommodation, they want the form completed directly by a medical health provider." However, during my initial conversation with the director of HR, I told her my physician may complete the form based on the recommendation of a mental health provider which she referred me to (EAP). The HR director sent me the form to have filled out and said, "have your physician complete this form." Is it legal for them to not follow the request of a physician using the mental health provider's info because of what others have done? I also met with the physician and completed a rating scale and discussion with her concerning my anxiety.
