Are they terminating me?, Unemployment with LTD or do I have wait until terminated? What can I do?
I been working at a big box store for 10 years I when out for surgery Dec 7 2012. I came back t o work March 7 2013 my manager approved my release from my dr. When my GM came back from a trip he told leave. I asked what did that mean he escorted me out the of the store. He finally he not reasonable I asked what that mean he said up to the dr. leave. This was going on for months. I called hq about it the leave department said you cannot be at work with restrictions in WA. I asked what does that have to do with me I work and live in NJ. The store HQ is in WA. I was on STD and end and that wait 7 months to be put on LTD because my hr rep messed up paperwork. I have called hq they all say work the change of command and hung up. I was never taught this or shown what that is. Been told my my GM waiting for a job assessment meeting from hq. I called hg and asked the leave department they state it on GM and I have a letter stating this (in Feb 2014). Now the problem is they say I'm part of the stores family, but there not allowing me to work because of my injury. They had the meeting Feb 5th 2014 I did know go because did not feel comfortable speaking to my GM and others on my personal cellphone. I was told the meeting would be all the managers and my GM on a three way call with hq and leave department on my cellphone. I have learning disabilities and it hard for me to understand of the phone. The meeting was not mandatory. The person at another company who was doing the meeting I explain to her my learning disability and it is documented since i was 2 years old. Her responds was get an legal aide this was Friday. I asked how is this going help to understand what you people say on the phone? and how do I get on short notice It Friday miss the meeting Wednesday? I see your point go to the union rep my store not union. Then she says get another manger there. I did not feel comfortable with that because at my store the upper management does not help the employee out they in for themselves. I was told my the lady running the meeting I would get paper work in the mail about the meeting. Never did I had to call her to requested that was weeks after the meeting. I have letter stating there no positions available at my location or a location I requested. I have never requested a location or spoke to the store of HQ about this. Then another letter stating my employee benefits have end. Also states please email the leave department about positions available. This letter I received end of Feb. I called hg about the letter because I was confused about. I have to talk to a man who has been calling harnessing my family demanding information about me. He also the one that state cannot work in the store with restrictions in WA and I lived in NJ. I deiced not to call and have some people get there option about the meaning of this letter. I when to another warehouse and talk to the GM who was very helpful. She gave me a name and number to call in personal. She looked in the situation and call me back. She called and stated you GM not at the store I cannot do anything farther. He never at the store that part of the problem I would go there often I said and bring him paperwork and talk or him but never there. I cannot help there she said. I received the notes from meeting on Feb 25 2014. It this letter it states there are no positions available with or without accommodations. Please email your GM my the 2/20/14 if you like to be resigned. If not not you will be terminated 60 days form the date of this letter I called the leave department the told to talk to the man that harnessing my family I said no can I talk to his boss sure the man said I transfer you to Julie the the director. I explain to her the situation she is very rude would not let me speak. She said you where not at the meeting. I know it was my choice because of my learning disability. You would know what it means then. Ok, let me ask this when yout GM says leave and tell not reasonable what does this mean? Since my Gm saying that up to HQ. She said any person would me that mean to walk out of his office. Right, but what reasonable mean that up to your dr. I told my GM very hard to communicate to and does not have an open door policy like the company states. I have and issue with processing inflammation I told and if she could simply what she was saying. She said now your asking for accommodations. Is that funny when we send this letters you ask for this now why did not you ask when first got hired? It was not a problem miss my GM then was very understanding. She also said you want some one to sit and heard the handbook to you? I said no miss that very insulting I can read. I just have problem understand things when it is spoken to me. My learning disability DOES NOT have anything to do with my foot injury. I asked how do you get accommodations at work? I also said I
m sorry there was not such thing as work accommodations when i started working at age of 15 this all new to me. She skip over all this and I will send yo u a form you have to fill it out and send it back. It is 3/11/14 still waiting on this from. My LTD has end March 4th. I get a copy of the same letter about me emailing the leave department about open positions to be relocated too just a date change on it. What can I do? HQ The whole box store very disorganized not helpful. They tell me all the same thing part of the store family what ever that means. They would even let you go to the lady room. Can of place we are are dealing with one big power trip.
