COMPENSATION FOR A PAID HOLIDAY

The company I work for has a policy in place that will not compensate you for a holday unless you average 35 hours a week during the 4 months prior to the holiday. This contnues throughout the year. Is this legal?

no right to holiday pay

there is no law that requires employers to pay employees for time not worked on holidays at all. so the company's policy is not illegal.
there also is no law requiring premium pay (time & a half, double time) for working on holidays.
