Discrimination/Retaliation/Harassment - pick one......
I have experienced a discriminative hostile work environment on a daily basis by my immediate supervisor. As a result, I’ve been diagnosed with severe depression; panic attacks, as well as high anxiety.
I followed the correct channels reporting several incidences to Human Resources regarding my supervisor, but instead of getting the help I needed and deserved the harassment continued, with no assistance from HR. On December 16, 2002 I filed a formal grievance with the Illinois Department of Human Rights (as well as EEOC). Charge: Discrimination/Retaliation Offense/Harassment. (Several factors to prove each charge)
They are currently investigating my claims.
For months, I remained quiet and allowed my integrity and self-respect be attacked. It is not fair to me as an employee or as a human being. I’ve been degraded, compared to an animal, publicly embarrassed through insulting comments, as well as in writing.
Per my doctors’ orders, I was put on a short-term disability leave. Throughout the duration of my leave my previous employer continually harassed me with correspondence. After reviewing a letter of my condition from my doctor, my doctor requested I be transferred to a different department, with a different supervisor. It was her professional opinion that I was subjected to an abusive and hostile environment.
While on leave, I was terminated from my position. The reason given “no other position available.” Question #1: Can they (meaning my previous employer) do that? I was not on any form of corrective actions. Question: #2 Should I seek legal counsel? Question #3: Do I have a potential case?
Any feedback would be helpful. Additionally, I met my predecessor, who will concur to the treatment received by this supervisor(she was treated the same way), as well as a co-worker. Both are willing to sign affidavits on my behalf.

Wow, you've been through hell and back, it seems. The answers to your questions are complicated. I need more information; did you have an employment contract, do you think your employer was harassing you because of your race, sex, disability, age, sexual orientation, and what does the employee handbook say about leave, how long had you worked there, how many employees are there in this company? These are just a few of the questions I need answered. Number two, yes you should seek legal counsel. Three, I don't know if you have a potential case, I need more information.
