Exempt employee travelling WAY too much.
Hi. I am an exempt employee in sourthern CA that works at a software company. My job title is Support Specialist, although I am more of a travelling technician.
I know that an employer can make you work overtime during the week, but can they expect you to travel on weekends ( sundays in most cases)? I knew that there was some travelling involved, but i did not know that there was NO comp time or extra pay for it. I am also being required to stay the weekend in somecases. What is the law for those who travel?

Most employees are non exempt unless they are in professional or managerial positions. Many employers like to label employees such as yourself as exempt to avoid paying overtime. Furthermore, it appears your employer misrepresented your job duties at your time of hire, by failing to disclose the work required on weekends. if your actual duties are not exempt duties, it doesn't matter what your employer calls you. you would be entitled to overtime.
each case needs to be examined on its own facts. you need to talk to an attorney experienced in wage and hour law, to determine if you are actually exempt from overtime laws.
