Former NPO director creates competing NPO - legal w/out non-compete agreement?

The former director of a non-profit trade school helped launch said school as the only school of its kind in the Midwest. And it was....until he was released from the position of director of this school because of financial restructuring and staff layoffs. Less than 6 months later, he launched the same school, under a different name, about 70 miles away. Same marketing campaign. Roughly the same mission, scope and target market. Is it legal? There was no non-competition agreement, however, he has created competition against a non-profit school that offers degree programs through its relationship with a state-funded community college.
