My boss said I resigned. I did not resign. Do I have any rights.

I work for Honda of Mentor Ohio (Penske Automotie) for 7 years, did a beyond a good job as a sales manager and was paid well and well liked.

The vice president took a dislike to me and wanted me out (paid too much, wanted a younger guy) even though my performance was outstanding and I got along well with others.

In a nutshell, I was sitting in my office with my immediate boss. I asked if the higher ups wanted me to resign. Boss replied yes. I walked out of the office to cool down. Ten minutes later returned and was told that my boss had called the higher ups and said I resigned, when I did not. I called the higher ups and told them I did not resign. There was nothing in writing.

Aside: Why would I resign? The supposed resignation date is 6/30. A closing on a house I had just purchased was on 6/5. I lost the house and my dream job. I am 50. They replaced me with a 31 year old.

Paul from the sound of your description you need to talk to an employment lawyer and also collect information in advance of the discussion by collecting for your attorney all of the information that you believe supports your statement that (VP wanted a younger guy) The issues raised will be significant and you should also do your best to seek new employment while you consider your legal options.
