Need a lawyer that can win retaliation case for this bookkeeper.
I have a 17 years stable, continueous work history with high integrity. Until this year. My Ex-employer denies that they fired me. They are refusing to pay my annual performance based bonus that I earned because they say I quit. The labor commissioner has a formal hearing scheduled in Jan. 2002 to review the facts. But the bigger issue for me is that they terminated my employement in retaliation for employer/employee issues that I was vocal to management about being unlawful. I believe that I have enough evidence to prove retaliation for being a whistleblower to upper managerment of this nationwide distributor. I did not contact local authorities nor did I threaten to. I was simply doing my job as a bookkeeper. But if they deny everything to the end am I fighting too expensive a battle? Or is my loss worth fighting in Superior Court?

I agree with Janet. It is difficult to evaluate your claim without additional information, particularly with respect to the type of conduct about which you were complaining and the circumstances surrounding your departure from the company. in california, you may have a claim for wrongful termination based on "whistleblowing" even if you did not report to outside authorities. much depends on your evidence, on the nature of the wrongdoing, and the other details of your case. you need to discuss your case with an attorney experienced in employment law. if you are in southern california, i'd be pleased to speak with you in a telephone interview.
