Overtime for salary
When my pay was changed from hourly to salary I was verbally told it would be based on a 45 hour work week but would be paid overtime on a quarterly basis for time work over 45 hours. Over the past few years my workload has dictated that I work 55-60 hours a week to stay current. My employer has just announced that no more overtime will be paid to salaried employees but we are expected to work as many hours as it takes to get our work done. I am not in a managerial position and do not fit any of the criteria to be exempt from the FLSA laws. I have never signed a salary contract. Am I entitled to overtime pay?

There are certain exceptions and it depends upon what you are doing. However, under the facts you have provided here, it does appear that you have overtime due and owing and are likely entitled to twice your overtime as a penalty (called liquidated damages). You should call or email us or any of the other excellent employment lawyers in Illinois as quickly as possible.
