Payroll lost check, someone cashed it
I work in IL for a company based out of WI. I went to pick up a check dated 12/26, and was told that the check was not there. Over a week later, after I had send in a request for a stop payment, I was told that the check was cashed. After being told many different answers by management, I asked the payroll director when I would be recieving my check to which she told me around two months. In the mean time, I would receive no compensation for their error of leaving my check in an unlocked file cabinet in the front of the store. I was also told that I have no legal right to this check. Is this possible? They commit an error, and I have to wait 2-3 months for them to correct it?

We would certainly need more information, but they have to pay you. You probably have a claim for minimum wage law violations as they paid you nothing and you can file a claim with the Department of Labor as well. You should probably review this with an attorney.
