Recently fired for being absent while my son with special needs was hospitalized!
I was recently fired for “excessive absences”? (My 7 year old special needs child was hospitalized for a chronic illness) Eligible for unemployment benefits? Discrimination case?
I happened to be working for a well-known auto insurance company and have only been employed for about four months. I do work from home as many due that are employed with this company. I’m not able to work for an employer in a typical brick & mortar location due to excessive illnesses with my son. So this job worked out great. Well, until my son got really sick & ended up in the hospital. I informed my immediate supervisor & also called into our “absentee line” and reported my absence & recorded my confirmation number provided.
Well, sometime during my absence my immediate supervisor was fired. Unbeknownst to me, I had received several emails from another manager in the same Dept, demanding that I respond to her message & include my return date. She also kept asking where I was & why I didn’t communicate my whereabouts to anyone!
By the time I was able to read & respond, but unfortunately, I was already too late! She had already let me go! I did go ahead and send an email to her and explain the situation. She responded by saying “We knew nothing about your whereabouts, nor has Brenda (immediate supervisor), who is no longer with the company, communicated anything either! In an email that I received from the other supervisor stated; “I could come back but would have to reapply again and also complete the 12-week training course! Now, a few days after receiving this email from her, I received an email from our external HR Dept stating that I was not eligible for rehire! I’m devastated!
PS: I was able to save all the emails related to this case! 😬
Unemployed = No income to care for my special needs child!
My questions:
1. Is this a possible discrimination case?
2. Could I somehow deem this company liable, or possibly even my current supervisor (Brenda) at the time, for not relaying important email communications regarding an employee?
3. I’ve already filled for unemployment compensation? Is there a likelihood that I would be granted these benefits?
