Reneging on job offer
Dear MEL,
I had an interview with a major company last week. At the interview, they made a verbal committment of a job offer. 2 days later, I sent them an email, accepting the job offer, to which they replied, saying they will send me a new hire packet soon. Today, when I phoned them they said that there was some miscommunication between themselves, and they cannot hire me. Could I sue them over mental agony caused by their carelessness?

That being said, you cannot sue a potential employer for the emotional distress resulting from a withdrawn job offer. Had you relied upon their offer and dramatically changed your circumstances (i.e. sold your house, moved here from another state, refused other job offers, etc.), you might have a claim for misrepresentation. Such claims are unusual and very hard to win. However, the facts as you set them forth do not indicate the basis for such a claim.
