Unfair Layoff Practices

I am a 49 year old woman who accepted a lower level first line
mgmt position last year with the understanding that promotion
to a higher level would be fairly quick. Upon taking the job, I
noticed that the entire company was made up of under 35 white
males. The promotion was given to a 32 year old white male. I remained
in my first line manager role until a layoff was
announced, at which time that same male rolled back down
and took my position and I was laid off.
Do I have a case here?

maybe. do you have any other evidence of gender- and/or age-based animus? also, was the younger male employed longer than you? you must prove that the nonpromotion and/or subsequent layoff were adverse treatment and that they were on account of your gender and/or age. also, if you moved to accept this job, you may have a statutory claim for misrepresentation. you need to speak with an experienced employment attorney. you can reach me at 805-658-0655. janet m. koehn
