Vacation rules and employee handbook
I negotiated and accepted a position with a new employer 7 months ago. My contract states I am eligible for 2 weeks paid vacation after Jan. 1st of this year.
After starting work I was given an employee handbook which states very un-clearly the policy for vacations. When I asked my boss about it, he said, yes, sure, according to your contract you get 2 weeks after the first of Jan.
But then the owner steps in and says,no, per the handbook,that vacation is accrued over the course of a year...Basically about 1 day every 6 weeks. If you leave employment and have taken vacation that wasn't accrued, you will be charged back for it out of your last check.
Had I of know this before signing, I would have done things differently. This isn't the only mis-representation between the handbook and my contract.
Is this legal?
