Violation of rights/false reporting to State agency
I am an RN in the state of Tx. My former employer (private home health business) reported false information to the Board of Nurse examiners. I was forced to surrender my license and was unable to be reinstated for a period of over 2 years. It wasn't until 18 months later that I obtained hard copies proving the charges were false. I endured much hardship, lost wages and emotional termoil over this. I know many of my rights were violated, but do not know what to do. I hope you can help. I cannot answer your question without legal research. You need a lawyer to sit down with you and look at this. There is a concept called "qualified privilege" which allows some people to say absolutely anything they want to a state agency. I do not know whether that would apply to your situation, so my advice is to talk with an employment lawyer. You also need to find out if the first question is whether the corporation that was responsible for the false report to the Bd of Nurse Examiners is still in existence. If you want to come to Houston, I would be happy to meet with you.
