What's the fml process for 2nd review of doctor verification?
On June 29 of last year I forgot to have another employee finish off 2 hours of my shift. I set out to travel stby and had a severe UC episode turned out laterto be severe hypokalemia so I returned home. 5 hours later I realized my error and used my employer's calling system, but it was well after the forgotten 2 hour lack of coverage had ended. 3 weeks later my mgr. calls me into her office and asked me a series of questions (without a union rep) and one was did I go to the ER and the name of the hospital the day of June 29 and other questions about my health. Though not relevant since it was much later after the shift had ended, I told her that my pc had already submitted the recertification 2 days after the incident since I went outside of my perimeter and he sent it to the company's medical team as required by the company policy not to give any medical paperwork to mgmt. I went on to tell her that and it was approved. My mgr suspends me anyway and a week later calls me at home while on suspension for me to bring her any ER discharge paper for that date even though it had nothing to do with me missing the 2 hours or attempting to travel, as a matter of fact I didn't travel because of my flare up, little did I know 7 days later after being suspended I would be hospitalized for a life threatening Hypokalemia brewing for over an month brought on by my UC. I simply forgotten the trade and that the penalty under the attendance policy for calling off late after your shift is an 2pt attendance violation. I mentioned that had forgotten to cover the last 2 hours of my shift. and that I didn't travel because my fml disability flared up at the airport so I returned home. (I have fml for Ulcerative Colitis.) I was suspended with pay. Little did I know that I had a life threatening illness brewing since or before June 29 that hospitalized me 7days later after my suspension . All brought on by my UC episodes. My employer verified with my primary care and he confirmed that he had treated me and had written and submitted the note two days after the incident he also sent the certification via fax to the company's medical team. However my ER visit could not be proven. this is the problem our medical team asked me not to send in the ER paperwork since the day was already covered and verified by another doctor, but my manager demanded that I send it anyway or else I would be terminated for failure to cooperate in an investigation. I was also told to sign my hippa waiver to her; my manager. I did not. Our medical team supported the pc note and never waivered or sided with my manager. My mgr. hated me for my union involvement and filing multiple complaints of workplace violence, discrimination and sexual harassment, also I was to file a complaint of wage theft for underpaying the Spanish Interpreters in my work area. isn't there an timeframe to request an 2nd opinion for fml? luckily I saved all recorded from my mgr and the medical team.
