Thank's for replying. I'm new at this so could you please tell mem what is the contact number of Cal. Labor Commissioner in San Francisco? Do you hear alot of case like me? and what is their solution ? did they finally have to return the salary or they're allow to keep it? what is the exception that you're talking about ? they were telling me they're going to call collection agency if I don't return it, is that legal? Please kindly reply. I need this money since I'm not working right now but I prefer to return it than 'causing any trouble in the future (like damaging my credit history, etc). Anyway please kindly reply, Thank's..:).
I believe that Labor Code section 221 would prohibit them from collecting these wages already paid but cannot tell you with certainty as there may be exceptions or something in your specific case to which this would not apply. So you could go to the the Cal. Labor Commissioner and try to get some free advice. Though you can't consider this legal advice cause I dont know if it will hurt you later -- you always have the option to wait and see if they try to file a complaint against you and just deal with it then. I just got letter from my previous company that laid me off saying that I have overpayment couple thousand dollars. Is it legally possible to keep the money and not returned it since they're the one who made a mistake to send it to me in the first place? Anyone know any labor law that say that? Please let me know...:).

That is all I can tell you off the top of my head. If you want a detailed consultation that will require an hourly fee ($200 per hour). Hardly worth the expense if you're just talking a couple thousand. However the Labor Commissioner, whose Tel. No. is in the phone book does not charge. Good Luck, RV
