ee worked 28 hrs, 8 hrs holiday pay & 8 hrs vaca pay = 44 hrs pay OT?

I need to be able to give my employer proof that in order for this employee who ended up having a 44 hr work week is not entitled to OT pay due to the fact that he did not actually work over 40 hours. In any response that I get, could I also please have a link to use as a reference to "back me up"?

Even though you should not be right, I think your statement is correct, however, getting any real confirmation through the newly redesigned DOL website is difficult. The Wage and Hour Division of the DOL www.dol.gov has some very simplisitc examples of hours and excludes holiday and vacation pay from the hours computation. I actually tried to find the regulation and it is no longer where my old links go.
