family life in evaluation

Can an employer state anything about my special education child in a formal evaluation? My employer stated "that Me often speaks of her own son who is a special education student, which makes me wonder how she would feel about him being a student in her class." Is this not breaking special education confidentiality laws, and also bringing in personal life into an evaluation that has nothing to do with my performance with in my job? The union made him take it out reluctantly after I faxed them a copy, but they stated I should contact a lawyer to find out about suing.
