incentive program for hourly employees
I often have trouble finding time to educate my employees during normal business hours that my business is open to the public. Also, I would like to put a program together to reward my inside sales people for increased sales. Can I put an incentive program together for increasing sales and have one of the requirements for participation that they will attend a certain amount of in-house educational sessions that would be held after hours (as non-paid time for hourly employees)?

The key is that you will have to pay time and a half for overtime. We would need far more information to make a legal recommendation, but if the incentive has the effect of paying more than the time and a half for the overtime, you might be able to arrange it. But again, I would want to review the entire program before providing legal advice on this issue.
