severance when offered job w/ outsourcer

facts:
1)employer has severance policy w/ point 'fail to accept job deemed suitable by company' gets no severance
2) employer outsourcing my job and position offered by outsourcer
3) employer offers no severance if don't accept
Am I legally entitled to severance due to fact 'suitable job' is not with original employer i.e policy implies job to be with original employer?
Has there been any legal challange to my employer's position?

An employer is not required to pay severance. If they do choose to offer severance policy it must be reasonable, fair, and nondiscriminatory.
