termination prior to end of 90 day probation
I am 2 days away from the end of my 90 day probation period. I have been in detox for 4 days and have been advised to go into inpatient treatment.
Can I be terminated if I am in the hospital?

If there have been performance problems prior to your entering detox, then the company could terminate you based on those problems, according to whatever guidelines they use for probationary employees. If there have not been work performance problems, the company probably cannot terminate you solely for entering rehab, but if you do not have the right to leave days under the company policy, which you probably do not since you have been employed for such a short amount of time, then you could possibly be terminated.

There is no law preventing a company from terminating you while you are in the hospital. However, if you have a disability, then there may have been a violation of the Americans With Disabilties Act. You should contact the Equal Employment Opportunity Commission (ww.eeoc.gov)
