unlawful termination?
I have been employed in a nursing home for 11 months and am no longer happy there. If I were to place an application elsewhere and they contact my current employer for reference, can my current employer terminate me because I am searching gor a new job?

Probably, but it depends on why they terminate you. If the only reason is that you are searching for a new job, yes they can do so. I would suggest that you should tell the prospective employer that you would rather that they not call the ct you urrent employer. Instead, you can offer them multiple other references, including at least one former supervisor -- as recently as possible -- to give them confidence that you will be a good and safe new hire even though they can't talk to the current employer.
I think you have to be careful telling them why you don't want them to contact the current employer because that is one of the most important references anyone has. If you know of an instance where they fired someone for looking, that might be something you could cite as a reason for your concern. You could ask them what you could do, or offer to them alternatively, to compensate for your request that they not call.
Good luck!
