Employment Law Attorney Orange CountyThe State Bar has a web site that has a search engine that will provide you with the educational background of an attorney and let you know if the attorney has been disciplined by the Bar. Otherwise the best way to check the "credibility" of an attorney is to meet with him and ask for references. I have an office in Irvine. Answer to Refuse to pay back-pay
OvertimeYour assumption is correct. You do have a right to ask for all of the overtime you have worked, but have not been paid as a result of your employers misclasification. If your employer refuses to pay this overtime, you and your co-employees can file a claim with the Dept of Labor Standards Enforcement. It is illegal for your employer to try to take any adverse employment action against you or your co-employees for attempting to enforce your rights. Answer to Wrongfull termination
Wrongful terminationYou can and probably should file a claim for workers' compensation benefits. Now that you have been terminated you may be without health benefits unless you can afford to make your Cobra payments. If you were to file a workers' comp claim, your employers carrier would pay for treatment of your work related injuries. Furthermore, you can file a claim for wrongful termination pursuant to California Labor Code Section 132(a). Additionally, you may have a civil claim for wrongful termination.
