It is a violation of Labor Code Section 132(a) to discriminate against you because you have made a claim for workers compensation benefits. Additionally you may have a civil claim for retaliation and discrimination. You should call an attorney for a consultation to protect your rights.

Yes an independent contractor does have rights under FEHA. Additionally, many employees are incorrectly labeled independent contractors by their employers when they really are employees. Most employment attorneys offer free consultations, you should speak to one.

Answer to i was on workmans comp but recently resigned and have another job w/c still sending disability checks what to do?

Assuming that you are receiving temporary disability checks you will need to let the insurance company know you are working and they will stop sending the checks. Workers Comp- Personal injury claim

You definitely have a workers' compensation claim and you possibly have a personal injury claim against the tire manufacture or your employer if their maintenance of the tire was willful in some way.
