I had to resign. I stated in my letter why and that I'm leaving under a constructive dismissal. I've documented many conversations and can provide nothing was ever done to accommodate medical work restrictions via workman's comp. My store manager abruptly left into a GSM position over night and without notice. This happened right after I found out my Workers Comp. Was never filed after asking about it for almost 6 months. I ended up getting the ball rolling myself but with the time frame I'm only allotted some physical therapy. I also contracted COVID 19 for the first time in August and was out for a month under FMLA. My cognitive and rational thinking took a huge hit I'm still trying to manage my life and work with a lot of difficulty.i was unfortunate to get it again in October. She started to Cut hours below the minimum 35 hours, and she and our district manager put together a retaliating PIP that is text book to the T a push to make me miserable and get me out. The write ups are for tardies and absences. After months of torment I finally gave in. My question, can I be compensated my reduced hours that fell below the minimum 35 hours, along with my accrued time off that I earned? Will a lawyer take my case to also get compensated for mental and emotional distress? My self esteem and confidence have been abused so badly that I fear it's going to affect me getting another job.
