Need to know if I can take any action about my termination...that happened during psychiatric treatm
I have worked at the same job for 16 years. This past July I had a breakdown. My boss set me up for short term disability and Family medical leave (both at the same time). I have been seeing two doctors. They said it could take 6 weeks to 8 months for me to recover, if I do. It is the end of October now and my disability benifits are up. My work sent me a letter asking me to respond within 10. I f I didn't it would be considered vouluntary resignation. I responded and said I was not resigning and they should contact my doctor. I just recieved another letter stating..due to hardship for my employer's buisness they can no longer hold my position. Do I have any course of action I can take.

The facts as you state them indicate the potential for legal claims that may save your job. These potential claims depend on how other employees on leave are treated and the dates on which you left and must return. You may have a course of action; however, it is likely that no matter what course you take, you are going to have some tough decisions to make.
