Non Disclosure and Confidentiality Agreements

I worked for "Company A" and was contracted to work for "Company B". Company B wanted to hire me as a full time employee and informed Company A of their intent. After receiving the offer letter from Company B, I told Company A that I was considering their offer. Company A then terminated me the same day I informed them of the offer. I had not gievn a notice to quit.

I have now received a letter from the attorneys of Company A first of all stating that I resigned and secondly the new job will require me to utilize, disclose and or benefit from from "Confidential Information" that was provided to me when I was employed with Company A. I did sign a non disclosure agreement and confidentiality agreement with Company A when I first started the job.

My question is even though my job roles have changed from Company A to Company B and I nor my present employer are in competition with Company A, can I lose my job through an injunction?

Non-Disclosures vs. Non-Competes

Sounds like Company A wishes it had a non-compete agreement but doesn't and is trying to bully you and Company B.

These types of cases are very fact specific so no one will be able to give you a definitive answer on this board without reviewing your documents and sitting down to discuss the specific facts of your situation with you.

I would strongly recommend that you find a board-certified employment attorney and purchase an hour of their time to go over these issues with him or her.

You might want to visit www.TELAONLINE.org to find a good employment lawyer that represents employees.
