Non-compete while in the process of leaving the firm

I have worked part-time for an IT company for about 3.5 months. The customer is a large U.S. Governemtn agency. I recently received an offer from a firm I interned with last summer. Their client is the same U.S. Government agency. Both companies are part of the same "blanket" contract.

I never was asked to sign a non-compete clause. Well a few days before my last day, I was asked to sign one. I declined to sign the contract, since I was about to leave. I had a phone conversation with my employer who hinted at legal action. I dont' know what exactly I'll be working on with the new company, but I know they use the same software. Can he take legal action against me? Should I contact a lawyer ASAP?

non-compete answer

If you did not sign a non-compete, I am not aware of any action the employer can take so long as you are not stealing anything, which I assume is not the issue. In any event, there is no need for a lawyer until the employer takes some action.
