What are my rights?

Can my employer cut my pay if they demote me for my ilness?They are trying to say I can not perform my required duties in shipping, even though I have my doctor's release letter saying I can return to full duty.They have transfered me to another dept. saying I am not able to drive a forlift because of my eyesight operations.My employer has not given me a chance to prove that I can still operate a forklift with any problems.Can I consider this discremination?

Demotion Following Illness

Your employer might be in violation of the Texas Workers Compensation law, the Family & Medical Leave Act, the Texas Human Rights Act, and/or the Americans with Disabilities Act. It's impossible to answer your question without a whole lot more information. You can read a lot about these laws at a website by a non-profit group -- at www.workplacefairness.org.

If you think your employer is violating the law, you should set up a consultation with a lawyer who regularly practices employment law -- and who knows these particular laws.
