Will I have to pay out of my non compete agreement

operations out of virginia, but I am employed in Alabama, in the non compete it states 10% of salary, if employed in same duties for 6 months after, AND if employed by a follow on contract. Government contract worker, the company only has one contract, ours which they have lost, and the follow on company wants to hire us all. can, if they no longer have a contract, and essentially no business, not as if they can offer us any other work, can they enforce the agreement?

also, just reading over the agreement. it basically is totally regarding a follow on contract, then with a small bit about being hired on by the contract employer. We cannot even have submitted resumes to the other company without breaching the contract.
