enforceable geography

Can an employer enforce a non-compete in their entire coverage area even if the individual employee never worked in the territory they are seeking to work in now? That is to say that the employer is a distributor covering 4 states and the employee seeks a position covering an area he previously did not cover with that employer. Can the employer enforce the non-compete over their entire 4 states?

There are a lot of factors that go into the enforceability of a non-compete and more often than not, broad non-competes are not enforced. But generally, before answering a question like this an attorney needs to review the non-compete and discuss with you what it is you want to do. I recommend that you contact our offices or one of the other fine employment attorneys on this site for a consultation.
