Is the EEOC right to sue letter useless against a private employment arbitrary agreement.

My employer adopted a private employment arbitrary plan stating you must use arbitrator and may not sue them in court. How scary is the EEOC to an employer if they know an employee can't sue regardless of a right to sue letter.
