Wage discrepancies based on Education & Experience

We work at a hospital & we recently found out that an employee in our department, who does not meet the educational requirements for the Technologist position (Bachelors Degree + experience), was hired as a Technician but is actually getting more compensation that other employees that have a Bachelor of Science degree & more experience. There are more than 10 Techs w/degrees and just 1 Technician. What is wrong with this picture? Is filling a grievance with the HR department worth the effort? Do we have any laws on our side? We do not belong to a union so that limits our efforts in getting this matter investigated to provide resolution.

The picture is indeed, "wrong," but legally, you have no recourse that I can imagine. Without any union agreement on seniority, qualifications, pay scales, etc. an employer is perfectly free to pay what it wants to whom it wishes to pay it. However, if race (black, hispanic, asian) or gender (female) or age (40+), national origin (vietnamese, mexican), handicap, religion (say, Muslim) or AIDS/HIV is a substantial motivating factor in the pay discrimination, then you may have a case against the employer. My advice is to consult your HR dept very, very carefully, and without seeming to have "sour grapes."

An employer does not have to pay employees equally. However, an employer cannot discriminate againt an employee for a prohibited reason. For example, the employer could not pay a white employee more simply because the employee is white.
