short term disability question...
Can you help me..or at least point me in the right direction? I work for a well known insurance company. I had to leave work, on short term disability, to remedy problems with my right shoulder, carpal tunnel in the right hand, right foot, and some back problems. I am awaiting a visit to the neurologist on May 15th to see if he can remedy the right wrist/shoulder problem and the back. I am being treated by a podiatrist for my foot. I am being treated by a chiropractor DAILY SINCE FEBRUARY 22, 2001 for my back. He has repeatedly faxed letters to the disability unit (group disability plan through my employer) in Texas stating I am unable to work because of spinal instability and cited that treatment will continue daily until April 30, 2001 at which time x-rays will be retaken. On March 9, 2001, my checks were suddenly terminated, which I was not aware of until I called to find out why the checks were late-again. My case worker keeps changing her story and her boss says it's my problem and I need to resolve it with the case worker. She is not honest or cooperative with me. I have spent days calling, faxing, driving or being driven to collect letters or whatever she says she needs that day. I have not been able to rest because of the constant 'running around' this case worker is making me do so I can get the checks due me. As a result, the problem with my back which might have been resolved sooner, has now continued. On top of that, I have been very stressed, crying, and so on because I cannot seem to make any head way in getting my checks. I called to find out today where we stand (I have called every day up to 8 times a day) and was told my case worker was out of the office. (She didn't tell me this yesterday.) I asked for information on how to appeal my checks being terminated and was told that since I had not received an official statement of termination in writing, which I haven't, that I could not do anything until that time. I explained that my checks had been stopped but no one will tell me why or how come or anything and that no one told me they were going to be stopped in advance. My doctors refuse to release me back to work. I would be willing to return to work when my back stabilizes so I can sit down properly and would 'wait out' seeing the neurologist on the 15th of May for the rest of my issues, however, I've not been able to rest because of all the 'issues' I'm dealing with in getting my short term disability checks. What can I do? Who do I need to contact? What legal rights do I have? I am under the care of three physicians right now. To boot, I have an autoimmune disorder and have begun to have problems again with it because of the additional stress I have been under with collecting my disability checks. Can you please let me know what rights I have regarding getting my paychecks, emotional distress, or who I can contact or if you know anyone who can help me? If they force me back to work and the problem with the hand, shoulder, back and so on gets worse, can I go out on workmen's compensation? I wish i could help you. I do not know if that could come under EEOC guidelines; but you may want to give them a call. Also you appear to have a worker's comp case...have you called an atty for that. Good luch
